Terms of Service

Last updated: 2026-08-30

These Terms of Service outline the mechanism and responsibilities for operating a gift program with [Missing: Entity Name]. By using our service, you agree to these operational boundaries.

Service description

First Year Flowers is a recurring weekly flower-gift management program. It allows a giver to configure, authorize, and fund a scheduled delivery of flowers to a recipient couple in observation of Shabbat, adjusting automatically for local sunset deadlines.

Authorization and funding

As a giver, you explicitly authorize and fund all purchases made through the platform. By default, every proposed weekly delivery request is placed in an "awaiting approval" state. Under this default policy, no order is submitted to the fulfillment provider without your explicit review and approval of the final quoted price.

Budget guardrails and behavior

The system employs two strict financial mechanisms:

  • Per-delivery cap: If a quoted order exceeds your configured per-delivery limit, it will not process automatically. It is flagged as an exception awaiting your manual intervention.
  • Annual budget: The program tracks cumulative spending against an annual budget. This budget runs for twelve months starting from the program's defined start date, independent of the calendar year. Deliveries that push spending past this guardrail require explicit override.

Fulfillment limits and exceptions

We rely on dedicated florist fulfillment networks. Consequently, our capabilities mirror their constraints:

  • Coverage: Delivery is contingent strictly upon the fulfillment provider's coverage area and local availability. We do not guarantee service to all zip codes.
  • Substitutions: Floral arrangements are subject to season and supply. Substitutions may occur within the provider's stated policy.
  • Holidays and blackout dates: There is no guarantee of delivery on dates blocked by Jewish holidays shifting the window, or blackout dates set by the provider. Weeks impacted by such limitations are not silently skipped; they are flagged as exceptions requiring your attention.

Program lifecycle

A program may be paused or cancelled at any time by the giver. The recipient couple may also request a pause or skip individual weeks. In the event of a cancellation or pause, any scheduled delivery requests that have not yet been approved and submitted will be halted. Orders already submitted to the provider are final and subject to the provider's cancellation policies.

SMS communication terms

We use text messaging to coordinate deliveries with the recipient. The program sends exactly one scheduled reminder per week, plus necessary transactional replies to commands. Message and data rates may apply depending on the recipient's carrier plan.

Recipients may reply HELP for command instructions or STOP to immediately opt out of all SMS communications.

Liability and disclaimers

The service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, regarding uninterrupted access to the platform or the exact availability of specific floral products. Our liability is strictly limited to the amount paid for the specific delivery in dispute.

Changes and jurisdiction

We may update these terms as the platform evolves. Continued use of the service constitutes acceptance of any changes. These terms are governed by the laws of [Missing: Jurisdiction].
